U.S. Trademark Applications with AI Goods or Services (% of Filings)

Latest

5.28%

Methodology

## What this measures

The percentage of each month's new trademark applications whose goods and services name artificial intelligence (see trademarks.us.ai_goods for the rules).

## Why it matters

The cleanest single line for how fast AI is entering the products companies plan to sell, by their own legal descriptions.

## How to read it

Higher means a bigger share of new products are described as using AI. The series starts in January 2000 at 0.04%. The latest month, September 2026, is 5.3%. The high is 5.7% (March 2026) and the low 0.00% (December 2001).

## What it does not say

An application is not a launch: many marks are abandoned, refused or never used, and one company can file many marks for one product. Counts move with USPTO fees and rules (the USPTO raised fees and changed how goods are described in January 2025) as well as with demand.

## How it's built

One count per application (serial number), by filing date. History from January 2000 comes from the annual backfile; from January 2025 Palanor keeps one row per application, first seen in the backfile or a daily file, and recomputes the last 24 months on every run. A month is published a week after it ends: new applications reach the daily file the day they are entered. Rules (tm-v1-2026-10-20), fixed before any count was read: a mark names AI when its words include AI, GENAI, GPT, LLM, LLMS, AGI, AIML, CHATGPT or the phrases artificial intelligence, machine learning, neural network, deep learning (or "A.I.") as whole words, after accents are dropped and the words are split on anything not a letter or digit, so "PERPLEXITY.AI" counts and "THAI" does not. Goods and services name AI when they include "artificial intelligence", "machine learning", "large language model", "generative AI", "neural network", "deep learning", "natural language processing", "AI-powered" (or -based, -driven, -enabled, -generated, -assisted), or "AI" in capitals as a whole word.
